These Terms of Service ("Terms") govern your access to and use of the Magicdraft website at magicdraft.io and all related services (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of entering into a legally binding agreement. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have the authority to bind that entity to these Terms.
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.
Magicdraft is a subscription-based SaaS platform that connects to your WordPress site, analyzes your existing content, identifies content gaps, and generates SEO-optimized articles that are published or saved as drafts on your WordPress site. The Service includes features such as content gap analysis, AI-generated article writing, internal linking, AI style learning, and automated publishing.
We offer a 7-day free trial for new subscribers. You must provide valid payment details to start the trial. If you do not cancel before the trial period ends, your selected subscription plan will automatically begin and your payment method will be charged. You are limited to one free trial per person or entity.
The Service is offered on a monthly subscription basis. The features and pricing of each plan are described on our Pricing page. We reserve the right to modify pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle.
All payments are processed securely through Airwallex, our third-party payment processor. By subscribing, you authorize us to charge your selected payment method on a recurring monthly basis. You agree to comply with any terms and conditions imposed by Airwallex in connection with payment processing. Your payment information is handled directly by Airwallex and is not stored on our servers.
All fees are exclusive of applicable taxes (including VAT, GST, or sales tax), unless stated otherwise. You are responsible for any applicable taxes associated with your subscription.
If a payment fails, we may retry the charge and/or suspend your access to the Service until payment is successfully processed. We may terminate your account if payment remains outstanding for more than 14 days.
You may cancel your subscription at any time from your account's Billing page. Upon cancellation, you will retain access to the Service until the end of your current billing period. No further charges will be applied after cancellation. We do not provide prorated refunds for partial months unless otherwise stated in our Refund Policy.
You may upgrade or downgrade your subscription plan at any time from your Billing page. Upgrades take effect immediately and are prorated. Downgrades take effect at the start of your next billing cycle.

All rights, title, and interest in and to the Service, including all software, algorithms, designs, trademarks, and documentation, remain the exclusive property of Magicdraft and its licensors.
You retain ownership of any content you provide to the Service (e.g., reference articles for style learning, WordPress credentials). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service.
Articles and content generated by the Service on your behalf are your property once published to your WordPress site. We make no claim of ownership over generated content. However, we do not guarantee that generated content is free from similarities with other published material, and you are responsible for reviewing content before publication.
The Service connects to your WordPress site via the WordPress REST API using Application Passwords. You are solely responsible for ensuring that your WordPress installation is properly configured and secured. We are not responsible for any issues arising from misconfigured WordPress installations, incompatible plugins, or unauthorized access to your WordPress site.
The Service may integrate with or rely on third-party services (including but not limited to Airwallex for payments and WordPress for content publishing). We are not responsible for the availability, accuracy, or performance of any third-party service. Your use of third-party services is subject to their respective terms and conditions.
You agree to indemnify, defend, and hold harmless Magicdraft, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to such processing.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after the effective date of changes constitutes acceptance of the revised Terms.
We may suspend or terminate your account at our discretion if you breach these Terms or engage in conduct that we determine is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, indemnification, and dispute resolution) will survive.
These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France. Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Magicdraft with respect to the Service.
